Welcome to the Kappa Malaysia website (the “Site”). These Terms and Conditions (“Terms”) govern your access to and use of the Site and any purchases made through it. By accessing or using the Site, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Definitions

“Buyer”, “you”, or “your” means any natural person or entity using the Site or placing an order. “Kappa Malaysia”, “we”, “our” or “us” means Gramas Apparel (M) Sdn. Bhd., operating the Site and the Kappa Malaysia brand. “Goods” or “Products” means the items offered for sale on the Site. “Order Confirmation” means the email we send confirming acceptance of your order.

2. Scope and Acceptance

These Terms apply to all visitors, users and purchasers of the Site. By using the Site or placing an order you confirm that you accept and agree to be bound by these Terms. All purchases made through the Site are subject to availability and acceptance by Kappa Malaysia.

3. Eligibility

You must be at least 18 years old to place an order. By placing an order you represent and warrant that you are at least 18 years old and have the legal capacity to enter into contracts.

4. Orders & Contract Formation

An order placed on the Site is an offer to buy. A contract between you and Kappa Malaysia is formed only when we send you an Order Confirmation email. We reserve the right to refuse or cancel any order for reasons including, without limitation, product unavailability, pricing errors, suspected fraud, or problems identified by our payment provider.

5. Prices, Payment & Taxes

All prices are shown in Malaysian Ringgit (RM) and include any taxes where stated. Shipping charges, handling fees and any additional charges (if applicable) will be shown at checkout. Payment must be made using the payment methods displayed on the Site. We use third-party payment gateways; by paying you also accept their terms and conditions.

If we reasonably determine an error in the price has occurred, we may cancel your order and notify you. If payment was taken, we will refund the full amount.

6. Availability & Product Information

Products are subject to availability. We endeavour to ensure product descriptions, images and specifications are accurate; however, colours, textures and measurements may vary due to screen display or manufacturing tolerances. We reserve the right to modify product information, discontinue products and change prices at any time without prior notice.

7. Delivery & Shipping

Delivery is available within Malaysia only unless otherwise stated. Estimated delivery times are provided as a guideline:

West Malaysia: typically 3–7 working days from dispatch.
East Malaysia (Sabah & Sarawak): typically 5–10 working days from dispatch.

Delivery times are estimates only and not guaranteed. We are not liable for delays caused by third-party couriers, customs, force majeure events, or inaccurate delivery information provided by you. Risk and title to the Goods pass to you on delivery to the address you provided.

8. Returns, Exchanges & Faulty Goods

We aim for your satisfaction. Please read our Returns & Refunds policy on the dedicated page [link to Returns Policy] for full details. Key points:

Faulty or incorrect items: notify customer service within 7 days of receipt. We will investigate and, where appropriate, offer a replacement, repair or refund.
Change of mind: returns are accepted within 14 days of receipt if the item is unused, in original condition and packaging with all tags attached (except where specific categories are excluded).
Non-returnable items: for hygiene and safety reasons certain items (for example, underwear, socks, earrings, swimwear unless sealed) are non-returnable unless faulty—these will be identified on the product page.
Return shipping costs: unless the return is due to our error (e.g., wrong or defective item), return shipping costs are borne by you.

Proof of purchase (order number or receipt) is required for all returns and refunds.

9. Warranty & Disclaimers

Products may carry manufacturer warranties where applicable. Except as expressly provided, all products are supplied “as is” and we disclaim all implied warranties to the fullest extent permitted by Malaysian law. Nothing in these Terms excludes liability for death or personal injury resulting from our negligence or for any other liability which cannot be excluded by law.

10. Account, Security & Passwords

If you register on the Site you are responsible for maintaining the confidentiality of your account details and password and for all activities that occur under your account. Notify us immediately at support@kappamalaysia.com if you suspect unauthorised use. We may suspend or terminate accounts where we reasonably suspect misuse.

11. Intellectual Property

All content on the Site including, but not limited to, text, images, logos, graphics, product designs and software are owned by or licensed to Kappa Malaysia and protected by intellectual property laws. You may view or print content for personal, non-commercial use only. Any other use requires our prior written consent.

12. Personal Data & Privacy

By using the Site and making purchases you consent to our collection and processing of your personal data in accordance with our Privacy Policy. We handle personal data in compliance with the Personal Data Protection Act 2010 (PDPA) and related regulations. 13. Cookies & Tracking

We use cookies and similar technologies to provide and improve our services. By using the Site you consent to our cookie practices as set out in our Cookie Policy (or Privacy Policy). You can control cookies via your browser settings but disabling cookies may affect Site functionality.

14. Limitation of Liability & Indemnity

To the fullest extent permitted by law, Kappa Malaysia and its affiliates are not liable for any indirect, incidental, special, or consequential losses arising from your use of the Site or purchase of Goods. You agree to indemnify and hold Kappa Malaysia harmless from any claims, liabilities, damages or expenses arising from your breach of these Terms or your unlawful use of the Site.

15. Force Majeure

We are not liable for failure or delay in performing obligations caused by events beyond our reasonable control (including, but not limited to, strikes, natural disasters, pandemics, acts of government, or courier failures).

16. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia. You agree to submit to the non-exclusive jurisdiction of the Malaysian courts.

17. Changes to These Terms

We may revise these Terms from time to time. Revised Terms will be posted on the Site with the updated “Last updated” date. Continued use of the Site after changes constitutes acceptance of the revised Terms.

18. Severability & Waiver

If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will remain in full force. Failure to enforce any right or provision does not constitute a waiver of that right.
